As a data user, the Society fully implements and complies with the six Data Protection Principles and all relevant provisions of the Personal Data (Privacy) Ordinance (Cap. 486) (the Ordinance). 1.2 We ensure that all personal data collected, held, processed, used, retained, disclosed, transferred, secured, and accessed are handled strictly in accordance with the duties and requirements stipulated in the Ordinance.\n<h2>Chapter 2: Categories of Personal Data Collected<\/h2>\nIn response to different service targets and operational needs, the Society holds the following categories of personal data:\n<h3>2.1 Membership Data (including individual members and representatives of corporate members)<\/h3>\n\u2013 Name, Hong Kong Identity Card number, contact telephone number, email address, correspondence address; \u2013 Personal data contained in the membership application form (refer to Article 2(2) of the Constitution); \u2013 Records of membership fee payments (refer to the fee schedule in Article 2(3) of the Constitution), attendance at general meetings and activities.\n<h3>2.2 Volunteer \/ Peer Counsellor \/ Outreach Team Member Data<\/h3>\n\u2013 Name, Identity Card number, contact details, educational qualifications and professional credentials; \u2013 Sexual Conviction Record Check (SCRC) and Certificate of No Criminal Conviction (CNCC) results (if applicable); \u2013 Service records, training records, outreach hours, and activity participation logs (refer to the description of outreach and peer education work in Chapter 1 of the Constitution).\n<h3>2.3 Service User Data (students, young people, lecture\/workshop participants)<\/h3>\n\u2013 Name, age, school attended, contact method; \u2013 Activity participation records, evaluation questionnaire responses.\n<h3>2.4 Donor Records<\/h3>\n\u2013 Names, contact methods, donation amounts and methods, bank or credit card details of persons who make monetary or in-kind donations to the Society, for the purpose of handling related administrative work (refer to Article 6(1) of the Constitution).\n<h3>2.5 Records of Board Members and Governance Body Members<\/h3>\n\u2013 Personal data (name, contact method, position, meeting attendance records) of the Chairman, Vice Chairman, Secretary, Treasurer, Executive Committee members, Board members, Chief Special Advisors, Special Advisors, Honorary Presidents, etc. (refer to Chapter 3 of the Constitution), used for fulfilling governance and legal responsibilities.\n<h3>2.6 Job Applicant Records<\/h3>\n\u2013 Used for human resources management purposes, including recruitment, selection, and employment.\n<h3>2.7 Website Visitor Records<\/h3>\n\u2013 Our service providers may record the domain name server addresses of website visitors and the pages they browse, but such records do not involve the visitors personal data and are used solely for statistical purposes.\n<h2>Chapter 3: Main Purposes of Collection and Use of Personal Data<\/h2>\n<h3>3.1 The main purposes for which the Society collects and holds personal data are as follows:<\/h3>\n<h4>(a) Membership Management<\/h4>\nProcessing membership applications, collecting fees, arranging general meetings and extraordinary general meetings, and exercising members rights and obligations as stipulated in the Constitution (refer to Chapters 2 and 5 of the Constitution).\n<h4>(b) Provision of AIDS Prevention Education and Outreach Services (refer to Chapter 1 of the Constitution)<\/h4>\n\u2013 Providing sexual health counselling to at-risk youth at gathering places such as parks, Lok Ma Chau bus stations, discos, and street corners; \u2013 Organising lectures, workshops, and drama activities for primary and secondary school students and tertiary students; \u2013 Implementing peer education programmes and training young peer counsellors; \u2013 Providing resource kits for teachers and youth workers; \u2013 Conducting the Sexual Awareness sex education groups and campus talks; \u2013 Sending young volunteers regularly to rave parties and dance events to deliver information about the consequences of alcohol abuse, soft drug use, and safe sexual behaviour.\n<h4>(c) Volunteer \/ Peer Counsellor Management<\/h4>\nProcessing volunteer applications and selection, conducting Sexual Conviction Record Checks (where necessary), arranging training and service matching, and recording service hours and providing service certification.\n<h4>(d) Donation Management<\/h4>\nHandling donation administration, including issuing donation receipts, sending thank-you letters, recording donation information, and processing matters related to tax deduction applications.\n<h4>(e) Society Affairs and Governance<\/h4>\nFulfilling the duties of the Board of Directors, Executive Committee, and Chairmans Committee as set out in Chapters 3, 4, and 6 of the Constitution, including convening meetings, preparing financial reports, and reviewing work plans.\n<h4>(f) Promotion and Publicity<\/h4>\nSending service information, event invitations, newsletters, and fundraising appeals to members, donors, service users, and volunteers (see Chapter 5 for direct marketing arrangements).\n<h4>(g) Internal Administration and Research<\/h4>\nConducting service statistics, studies, and surveys to improve service quality and evaluate social impact (e.g., the effectiveness of AIDS prevention education). 3.2 The Society will not use or provide personal data to third parties for purposes unrelated to the Societys objects, nor will it sell or transfer personal data to other organisations for commercial purposes without the data subjects explicit consent.\n<h2>Chapter 4: Accuracy and Retention Period of Personal Data<\/h2>\n4.1 The Society takes practicable steps to ensure that the personal data it holds is accurate and is not kept longer than is necessary for its actual purposes. 4.2 The general retention periods for various categories of personal data are as follows:\n<h4>(a) Membership Data (individual and corporate)<\/h4>\nRetained for no more than seven years after termination of membership, to facilitate follow-up and handle enquiries (refer to the financial record-keeping requirements in Chapter 6 of the Constitution).\n<h4>(b) Unsuccessful Membership Application Data<\/h4>\nRetained for no more than six months after notification of the application result, after which it will be securely destroyed.\n<h4>(c) Volunteer \/ Peer Counsellor Data<\/h4>\nRetained for no more than two years after termination of service. If the application is not successful, the personal data (including SCRC and CNCC results) will be securely destroyed within six months of completion of the selection process.\n<h4>(d) Service User Data (lecture\/workshop participants)<\/h4>\nGenerally retained for no more than two years, or extended for specific research projects with prior consent of the data subject.\n<h4>(e) Donor Records<\/h4>\nIn accordance with the requirements of the Inland Revenue Ordinance, donation receipts and related records must be kept for no less than seven years to comply with audit requirements for tax deductions.\n<h4>(f) Job Applicant Data<\/h4>\nRetained for no more than two years after completion of the recruitment process, after which it will be securely destroyed. 4.3 When personal data is no longer required for the purposes for which it was collected, the Society will ensure that it is permanently deleted or anonymised in a secure manner so that it no longer identifies individuals. \u2014\n<h2>Chapter 5: Direct Marketing<\/h2>\n5.1 The Society intends to use personal data of members, donors, service users, and volunteers (including names, telephone numbers, email addresses, and correspondence addresses) for direct marketing purposes, including but not limited to sending service information, event invitations, volunteer recruitment, donation appeals, lecture and outreach activity notices, and newsletters. 5.2 In accordance with section 35C of the Ordinance, before using personal data for direct marketing, the Society must: (a) Prior notice: inform the data subject that we intend to use his\/her personal data for direct marketing; (b) Obtain consent: provide a clear channel for the data subject to indicate whether he\/she consents; (c) Provide information: clearly state the types of personal data to be used and the categories of services\/activities to be marketed; (d) Provide opt-out: offer a free-of-charge channel for the data subject to request cessation of use of his\/her personal data for direct marketing at any time. 5.3 If a data subject does not wish to receive direct marketing materials, he\/she may at any time and without charge notify us in writing to request cessation of such use. Upon receipt of such request, we will immediately stop the relevant use. 5.4 If the Society intends to provide personal data to a third party for direct marketing purposes, it must first obtain the data subjects written consent and strictly comply with sections 35J to 35L of the Ordinance.\n<h2>Chapter 6: Security of Personal Data<\/h2>\n6.1 The Society takes all practicable steps to protect personal data from unauthorised or accidental access, processing, erasure, loss, or use. 6.2 Specific security measures include: (a) Access Control: Only authorised staff and designated personnel may access personal data, and their access rights are limited to what is necessary for the performance of their duties. (b) Data Encryption: All personal data transmitted or stored electronically will be protected using industry-standard encryption technology. (c) Physical Security: Personal data stored in paper form is kept in locked storage facilities, and unauthorised persons are not permitted to enter the storage areas. (d) IT Security: Our computer systems and networks are equipped with firewalls, antivirus software, and other security measures to prevent malicious software and unauthorised access. (e) Staff Training: The Society provides regular training on personal data privacy protection for staff and volunteers to ensure they understand and comply with relevant regulations. 6.3 If the Society engages third-party service providers to process personal data (e.g., cloud storage, data processing services), we will take appropriate contractual measures to ensure that such providers maintain security standards equivalent to those of the Society.\n<h2>Chapter 7: Disclosure and Transfer of Personal Data<\/h2>\n7.1 The Society may disclose or transfer personal data to third parties in the following limited circumstances: (a) To verify the background or needs of service users by making enquiries to relevant schools or institutions (with the data subjects consent); (b) To conduct Sexual Conviction Record Checks and Certificate of No Criminal Conviction checks by submitting relevant personal data of volunteer applicants to the Hong Kong Police Force; (c) To handle tax deduction matters by submitting relevant donation records to the Hong Kong Inland Revenue Department; (d) To conduct service research and evaluation by providing anonymised statistical data to academic or research institutions engaged by the Society; (e) To comply with any legal, regulatory, or court order requirements. 7.2 Except as stated above, the Society will not disclose or transfer personal data to any third party without the prior consent of the data subject. Personal data collected by the Society will be kept strictly confidential.\n<h2>Chapter 8: Rights of Access and Correction of Personal Data<\/h2>\n8.1 Under sections 18 and 22 of the Ordinance, data subjects have the right to request access to and correction of their personal data held by the Society. 8.2 A data subject who wishes to access or correct his\/her personal data should make a written request to the Society and provide sufficient information to verify his\/her identity. 8.3 The Society will respond within 40 days of receiving a data access request, in accordance with section 19 of the Ordinance. 8.4 Except where expressly permitted by section 28 of the Ordinance, the Society will not charge any fee for complying with or refusing to comply with a data access or correction request. 8.5 If the Society refuses to comply with a data access or correction request due to an applicable exemption, we will record the reasons for refusal and keep such record for no less than four years in accordance with section 27 of the Ordinance.\n<h2>Chapter 9: Use of Cookies<\/h2>\n9.1 The Society\u2019s website may use cookies technology. Cookies are small text files that a website stores on a visitors computer hard drive to record browsing preferences and improve user experience. 9.2 The cookies used by the Society do not collect personal data that can identify individual visitors. If cookies involve the collection of personal data, we will provide a clear Personal Information Collection Statement before collection and obtain the visitors informed consent. 9.3 Visitors may adjust their browser settings to refuse cookies, but this may cause some functions of the Societys website to operate improperly.\n<h2>Chapter 10: Disclaimer<\/h2>\n10.1 The Society has taken all reasonable and practicable steps to protect the security of personal data, but due to the nature of the Internet, we cannot guarantee that data transmission over the Internet is absolutely secure and uninterrupted. The Society shall not be liable for any data leakage or loss caused by circumstances beyond its reasonable control (including but not limited to hacker attacks, computer virus intrusions, and telecommunications network failures).\n<h2>Chapter 11: Updates and Amendments to the Privacy Policy<\/h2>\n11.1 The Society reserves the right to update or amend this Privacy Policy Statement at any time.
